STATUS PERUSAHAAN MILITER DAN KEAMANAN SWASTA (PRIVATE MILITARY AND SECURITY COMPANIES) DALAM HUKUM HUMANITER INTERNASIONAL

Perusahaan Militer dan Keamanan Swasta (PMSC), lebih dikenal sebagai "tentara bayaran" memainkan bagian penting dalam perang baru-baru ini dan konflik di seluruh dunia. Masalah datang ketika keterlibatan mereka dalam permusuhan tidak tunduk pada hukum kemanusiaan internasional. Berdasarkan Pasal 47 Protokol Tambahan Konvensi Jenewa, ada persyaratan tertentu yang harus dipertimbangkan karena keterlibatan PMSC dalam situasi perang atau konflik bersenjata. Namun, di lapangan persyaratan agak diabaikan. Status untuk keterlibatan permusuhan masih belum jelas. Menurut penulis, jika PMSC terlibat dalam pertempuran, maka mereka akan dianggap sebagai kombatan, serta merepresentasikan target-target militer. Untuk itu, tentunya mereka dapat diserang dan menjadi subjek hukum humaniter internasional. Tulisan ini akan membahas masalah-masalah terkait dengan status PMSC dalam perang atau konflik bersenjata, dan peraturan atau aturan sejalan dengan partisipasi mereka dalam situasi seperti itu.
